BC van der Berg Attorneys is a law firm led by a seasoned litigant attorney, first admitted as an advocate in 2005 and later converted to an attorney with right of appearance in the High Court of South Africa. In addition to litigation services, the firm also offers mediation services (excluding family law matters). For services not rendered, we will gladly refer you to a vast network of service providers.

Costs and Professional Fees
The concern of legal fees:

Though this quote does not relate to prospective clients and legal practitioners, it finds application when considering why people fear to use the services of legal practitioners. The key is communication. This section of our webpage addresses this issue.
Guidelines:
The tariff for our professional services is based on the following criteria:
- The volume and importance of the work done;
- The complexity or novelty of the instruction;
- The skill, labour, specialized knowledge and responsibility involved on the part of the attorneys;
- The importance of the documents prepared or perused, without necessarily having regard to the length;
- The circumstances in which instructions are received;
- Where money or property is involved, the amount or value thereof;
- Whether the work is conducted in office hours, after hours, over weekends or public holidays; and
- The experience or seniority of the attorney.
Fees and Costs:
We generally deal with complex High Court matters. Therefore, our hourly rate is R1 900,00. We however do not scuff at smaller instructions and may reduce our fees as low as R900,00 an hour. Our rate will be agreed upon in our letter of engagement.
To create better certainty for prospective clients, we charge a first consultation fee of R1 500,00. This includes:
- A 1-hour consultation; and
- An instruction fee.
Under exceptional circumstances, and upon accepting an instruction without a formal consultation, a R900,00 instruction fee will be charged.
Other exceptions to the aforementioned are when matters are taken on a contingency fee agreement or pro bono. Strict compliance with the Contingency Fees Act will be addressed at the first consultation and a contingency fee agreement will be drafted.
Because criminal law matters are received under different circumstances, different considerations apply. We generally receive instructions dealt with in the Magistrates' Courts and at police stations. Attendances to criminal law matters tend to entail long waiting hours and we therefore require a deposit of R7 000,00 per attendance. Because of Bennie's seniority, his matters are sometimes quickly attended to in court. He will then revert to his hourly fee and request a top-up deposit for the next appearance.
Instructions for attorneys will be handled on an ad hoc basis.
Generally, deposits will be required against which fees and expenses will be deducted.
Expenses may include sheriff fees, expert fees, correspondent attorneys' fees and advocate fees.
Ante-Nuptual Contracts (ANC):
We provide an all-inclusive fee package of R7 000,00:
This includes a 1-hour consultation, drafting of the ANC documents, including the power of attorney, a follow-up consultation and attendance to signing and attendance to a notary public, including the fees of the notary public.

Mediation Services
Services as Mediator
A day fee of R7 000,00 will be charged which the parties must equally contribute towards, unless agreed to otherwise.
If the parties reach a settlement, an hourly fee of R1 900,00 will apply.
We do not offer mediation for:
- Family Law matters; and
- Generally, for Labour Law matters.
We refer Family Law matters to expert mediators in this field of law.
We also represent clients at Alternative Dispute Resolution (ADR) proceedings:
